DINGHY INSURANCE POLICY 310307

This policy including all endorsements attachments amendments & renewals is a contract between Syndicate no.2001 at Lloyd's which is wholly owned and managed by Amlin Underwriting Ltd r/o St. Helen's, 1 Undershaft London EC3A 8ND reg. with Financial Services Authority no.204918 & Society of Lloyd's no.01901D and the named Assured(s) based on submitted proposal form & details which must be kept up-to-date over entire insured period. Insurance available only to permanent residents of the U.K. & C.I. & for such persons only craft permanently based in the U.K. or C.I.

The main provisions are: 1. Proposal assured must complete truthfully and fully with all known information.2. Schedule details the items covered or where blank not insured. 3. Policy, endorsements, attachments & enclosures including 'about us + keyfacts' all forming part of the contract. 4. Claim instruction sheet tells you what to do if accident or theft so important to read it now + the following:
NEVER admit or accept liability, it could void your policy. Instead, use tear-off section of yellow Claim Advice Form.
RETAIN all damage, however small, as inspection may be required and without it the claim could be void.

Definitions: Assured must be the owner of the craft, all owners must be named. Sum Insured: the maximum which will be paid for each item on the schedule for each incident of loss or damage. Exclusions: those items, persons & situations the policy does NOT cover. Warranties & Conditions: those items the Assured must comply with as a continuing obligation for the insurance to be valid.

Please read policy attachments and enclosures very carefully and revert to Newton Cram if you have any questions.

Section I. Loss of or damage to the Craft gear & equipment.

Underwriters will at their option pay to replace or repair loss of or damage to the Craft & equipment up to the maximum sums stated in the Schedule arising out of external accidental causes including fire, lightning, collision, vandalism, storm, flood, grounding, riot, strike, explosion, transit, civil commotion, sinking from an insured peril, burglary or theft of craft and following forcible entry or removal by force theft of gear & equipment, whilst ashore or in transit or being raced or sailed on inland & coastal waters of the UK ( or C.I. if based there) plus after transit by road/rail/ship or plane thereto coastal & inland waters of CI/lOM/Swiss/Norway & EU countries in Europe for periods not exceeding 90 days a year. Total loss of entire craft the sum which Underwriters will pay is limited to the new cost up to Maximum Sum Insured in Schedule for craft up to 12 months old or current market value, if lower, thereafter. Partial loss Underwriters will pay the reasonable cost* of repairing or replacing like for like items lost or damaged from an insured peril up to the stated Scheduled sums less applicable policy excess but spars, sails, rigging, foils & covers may be subject to deductions new for old at Underwriters discretion, Outboards per Threestrokes Guide current used prices. Reinstatement as nearly as reasonably practicable to be deemed sufficient even though the former appearance & condition of the property may not be precisely restored. * Underwriters retain the right to decide what repairer or supplier is used & must agree estimates.

Emergency Fees up to £5,000 of doctors, surgeons & ambulance for 1st 24 hours after an accident for emergency attendance to named Assured for personal injury directly caused by violent external visible accident aboard the insured craft.

EXTRA Cover - where Assured has paid additional premium extension C "Extra cover" the policy extends to provide New for Old replacement cost value cover for such spars, rigging and sails that are less than six years of age at time of loss.

EXCLUSIONS - Underwriters will not pay for or in the respect of:

(a) theft or vandalism loss or damage unless reported to police within 24 hours of discovery.
(b) loss of use or personal expenses unless agreed in writing by Underwriters or loss of value to craft after it has been repaired.
(c) scratching or bruising in transit, trailer damage from road shock or tyre puncture or weld or suspension failure or lack of maintenance.
(d) sails or covers split by the wind or blown away unless damaged by a solid object or breakage of spars to which they are set.
(e) cost of making good or remedying any fault in design, construction, material or inefficacy of previous repair, or cost or expense incurred due to betterment or alteration in design/model/construction or material of craft or any component.
(f) any claim arising from use of craft for any activity for which a charge or payment is made, or hire, charter, reward, advertising, or craft owned by trading companies, schools, authorities, clubs or associations (unless specially agreed in writing).
(g) any claim whilst craft is used as a tender to or for another craft or yacht (unless specially agreed in writing).
(h) any claim whilst craft is participating in a race or event extending beyond daylight hours (unless specially agreed in writing).
(i) persons owning or using insured craft who earn from any involvement in the Dinghy or Yacht trade or business including those in: schools, charter, hire, boatbuilding, sailmaking, brokerage, instruction or sponsorship, unless specially agreed in writing. (Unpaid or uncharged for instruction is not excluded).
(j) loss, damage, expense or liability arising from; capture, seizure, arrest, restraint or detainment, war, civil war, revolution, rebellion, insurrection, civil conflict or from ionising radiations from or contamination by radioactivity or nuclear activity, or loss caused by trick, deception, fraud or insolvency.
(k) willful misconduct or lack of due diligence of the Assured to which he/she consents; or confiscation by Government Agencies.

EXCLUSIONS APPLICABLE TO SPECIFIC CLASSES, MAKES & TYPES OF CRAFT & SPARS (see also overleaf)
(l) GP14, 505, ENTERPRISE & similar shroud supported masted craft built pre-1982 are not covered for loss or damage IF caused by pulling out of shroud anchorage or block especially due to failure of screws or fixings or of the wood backing itself; nor from grp hull & deck bonding failure.
(m) 420 breakage of KAPPA section masts, or chain plate/hull moulding or bonding failure in craft outside makers guarantee period.
(n) SOLO, Proctor C section masts unless collar and chocks fitted to prevent failure.
(o) LASER, failure of bonding between hull & deck or mast socket base or top outside guarantee period, rudder loss unless safety line attaches rudder unit to hull for recovery when rudder clip fails.
(p) TOPPER mast socket damage unless protection cup has been replaced when found worn, Rudder loss unless safety recovery line fitted.
(q) SAILBOARDS - excluding: wave boards, kite boards, more than one insured board same policy afloat at same time, breakage of board from contact with water alone or scratching, wear, defacing of graphics or decals. EXCLUDING THEFT of board or spars left unattended on roof rack of vehicle while in transit unless secured by lock to vehicle itself but excluding being left overnight on top of vehicle. At fenced locked c!ub compound board may be left on designated storage rack if separately locked thereto otherwise it and always spars, foils & sails must always be locked inside a locked building, vehicle or caravan.
(r) OUTBOARD - excluding cover to or use of outboards in excess of 6 horsepower (unless specially agreed) or claims where serial number isn't provided.
(s) CANOES, ROW BOATS are subject to THEFT EXCLUSION provision as per (q) above except when in owners own fenced garden.
(t) Excluding craft using or fitted with HYDROFOILS.

SECTION II Liability to others

Underwriters will indemnify the Assured in respect of claims which the Assured shall by reason of interest in the insured craft not otherwise excluded become legally liable to pay and shall pay including law costs for defence & marine salvage agreed in advance. The indemnity payable in respect of any one accident or series of accidents arising out of the same event shall be limited to the sum stated in the schedule. All borrowers of craft &/or crew automatically become additional named assureds whilst on or about the insured craft. This policy does not confer any enforceable rights to any third party notwithstanding the provision of the Contracts (Rights of Third Parties) Act 1999.

Additional Exclusions applicable to SECTION II:

Excluding liability arising out of the transit of the Craft in or on any mechanically propelled vehicle, watercraft or conveyance or arising under circumstances where any road traffic legislation would apply. (Note-when carried on or towed behind a vehicle the liability for damage or injury to others must be insured by the vehicle's insurers). Excluding liability to assured or any other owner of the insured property or Assured's property or property in the care custody or control of the assured. Excluding also any claim arising directly or indirectly from any accident to or illness of workmen or any other person employed in any capacity whatsoever by the Assured (or any other person to whom the protection of this insurance is afforded) in, on, about or in connection with the craft. Excluding punitive or exemplary damages. Excluding claims arising out of unseaworthiness of Craft, Gear or Equipment. Excluding Kiteboarding.

The following warranties & exclusions also apply, please read carefully.

STORAGE WARRANTIES: NO INSURANCE is provided UNLESS you have complied with following:
Craft - unattended overnight must be stored at home, inside a secure building or designated boating club or within secure gated area. Hull/foils/spars/sails must be permanently marked with class number or owner's postcode.
Inflatables must be stored only inside a locked building or locked caravan or vehicle when unattended overnight.
Sails, unsecured gear, fittings left overnight must be stored in home inside locked vehicle or locked building - never left on boat.
Foils-Laser & Topper foils must be stored at home, inside locked vehicle or locked building - never left on or under boat.
Trailer- must be itself wheel-clamp or hitch-locked or stored in locked building in addition to being marked with class & number or owners postcode.
Outboard must be locked to transom of craft if left unattended at all, but overnight must be stored inside locked vehicle or locked building not left on transom of dinghy. Serial number must be provided in event of theft or claim not accepted .
Trolley - must be marked with class & number of boat or owners postcode.

MOORING: NO insurance is provided for craft left unattended afloat (unattended meaning assured not close enough to keep it under constant visual observation so as to prevent unauthorized interference with it or theft or damage from weather or sea conditions.)

EXCLUDED LOCATIONS: No insurance is provided to craft stored overnight [other that at private homes] at: ABERSOCH, Bexhill, Blackpool, Brighton, Broadstairs, Christchurch (except Christchurch Sailing Club compound), Fairlop Water, Herne Bay, Highcliff, Mudeford, Pevensey Bay, Royal Plymouth Corinthian Yacht Club, Seaford coast, or at Sailing Clubs: Broadstairs, Catamaran YC, Fairfield G&SC, North Herts East Beds S.C. EXCEPT as participant for the duration of their race meetings where visiting craft are allocated safe secure monitored storage by host club/Association, ABERSOCH storage must be monitored 7/24 and arrangements in place to move craft to safety during high tides but overnight never less than 15' above highest flood tide line experienced past 6 years, exceptional weather or if owner not present. Excluding also craft based on Scottish islands not connected by road bridge to mainland.
FLOOD - TIDAL SURGE - MOORED or AFLOAT. NO INSURANCE is provided for loss or damage due to flood or washing away where craft left in area known to have flooded or tidal surged over past 5 years, enquiry must be made as ignorance is no excuse.
TIE DOWN - LOCK DOWN. Warranted craft left unattended overnight are securely tied down to stakes/bolts/etc in addition to chocks, trolley or trailer -this security to be checked not less than once a month throughout year. This warranty waived when visiting clubs in designated boat park where one cannot drive stakes or secure to ground. Craft kept on racks, piers, jettys to which public may access must be locked down thereto.
BUOYANCY - Warranted one aid per crew member must be made available and crew requested to wear such.
DETERIORATION - Excluding loss or damage caused by or resulting from: wear & tear, deterioration, weathering, chafe, vermin, insects, fungus, rust, rot, corrosion, fatigue, delamination, glue or resin bond (allure or wearing through of mast tube.
MAINTENANCE - assured must inspect craft not less than once a month throughout the year to check all including that cover in place, hull bailed out, tying down secure, and that all items of maintenance & renewal have been determined & done including all rigging, shackles, chain plates checked completely at least once a month, all spars are checked for signs of stress cracking or corrosion especially where rivets attach dissimilar metals and if such found or rivets loose or in wood rot or softness or glue line separation found, that such items are renewed. Sail batten pockets repaired where starting to fray or wear through. Chain plates & rigging attachment blocks and fittings must be frequently checked lo determine sound & well fixed and attached. Replacement of worn items required to prevent breakage or failure is a prime requirement on owner to validate the insurance.
Craft, Spars, Rigging, Foils, Sails & Equipment must always be maintained managed and operated to a sound, safe, seaworthy state & condition fit for all situations and conditions of use & storage undertaken.
LOANING boat. The policy extends, other than where exclusions (f) through (i) apply, to cover loan of craft to family & friends where enquiry has determined they do not have record of boating losses or claims. While the craft is on loan all users become additional named Assureds and except for Assured's immediate family the policy excess is doubled during such periods.
EXCESS is the first portion of every claim, other than total loss of entire outfit, the Assured must pay. The excess is shown on the schedule and for sailboards over 5 years old and dinghies over 8 it may be doubled for age. The excess is (further) doubled for claims arising outside the UK and may be doubled where 2 or more unrelated owners separately use the craft.
OTHER INSURANCE. This insurance shall in all cases act as excess cover, not co-insurance or primary cover to any other insurance.
PERSONAL EFFECTS. Where premium paid for this extension it covers the Assured's own clothing, waterproofs, buoyancy, camera, watch, spectacles, kit bag, tools & toolbox etc. EXCLUDING, however consumable items, cash, credit cards, cycles, fishing gear or any electrical telephonic or computing devices. Excluding loss arising out of; damp, or theft unless items within locked: vehicle, caravan, building or within boat clubhouse.
CLAIM CO-OPERATION. The Assured shall render to the Underwriters all possible aid in obtaining information & evidence should they take proceedings in the name of the Assured at their own expense to recover compensation or secure indemnity from third party.
REPAIRS & REPLACEMENTS - obtain advice from us 1st, quotations may be obtained without delay but do not proceed until insurers have confirmed acceptance of the quotations) or alternatives. Failure to adhere to this may void your claim. All damage must be retained for inspection.
Disclosure/mis-statement. If this policy or any renewal has been obtained through omission to state any material fact, claims or through mis-statement by Assured or anyone acting on their behalf or if any claim shall contain any untruth or suppression, this Policy and any renewal thereof is null and void and all benefits and rights forfeited.
CANCELLATION. The payment sum on the Schedule represents the total premium, tax & charges due to effect or renew the insurance. Should any method of premium payment fail to clear fully the policy or renewal will automatically be cancelled retrospectively as at that 1st day of the Period of Insurance. If cancelled by the assured if no claim made in the current period of insurance a refund of the premium & tax portion only will be allowed calculated at 50% where policy has run for less than 30 days, 25% up to 60 days, nil thereafter but for transfer credit to new owner or another policy with NC1 a pro-rata credit will be allowed. Cancellation by Underwriters refund is calculated at pro-rata. The policy automatically terminates on sale of the insured matter. Cancellation may be made by Assured giving 10 days written notice to Newton Crum, Underwriters by 10 days notice recorded delivery to Assured's last known address.
THE DUE OBSERVANCE AND FULFILLMENT of the terms, conditions, warranties contained herein or endorse to this Policy and Schedule by the Assured shall be a condition precedent to any liability to provide indemnity under this policy. Data Protection, Complaints & Renewal details are set out on 'About us + keyfacts" form which forms part of this document. Law, the law applicable to this contract shall be subject to English Law.
